1. Acceptance of Terms

By accessing and using the DustGuard Ltd website and services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our website located at www.dustguard.company (the "Service") operated by DustGuard Ltd ("us", "we", or "our").

2. Service Description

DustGuard Ltd provides comprehensive cleaning and maintenance services for residential, commercial, and industrial properties. Our services include but are not limited to:

  • Residential property cleaning and maintenance
  • Commercial and office space cleaning
  • Industrial facility maintenance
  • Post-construction cleanup
  • Specialized cleaning services (carpet, window, floor cleaning)
  • Scheduled and emergency maintenance services

3. User Accounts and Responsibilities

To access certain features of our Service, you may be required to create an account. You are responsible for:

  • Maintaining the confidentiality of your account and password
  • All activities that occur under your account
  • Providing accurate and complete information when creating your account
  • Updating your information to keep it current
  • Ensuring you are at least 18 years old to create an account

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Service Requests and Booking

All service requests must be made through our website, phone, or authorized representatives. Service bookings are subject to availability and confirmation. We reserve the right to:

  • Refuse service to any customer for violation of these Terms
  • Require payment before providing services
  • Cancel or reschedule services due to weather, emergency situations, or other circumstances beyond our control
  • Charge additional fees for services outside the scope of the original booking

5. Payment Terms and Billing

Payment for services is due as specified in your service agreement or quotation. We accept the following payment methods:

  • Credit and debit cards (Visa, Mastercard, American Express)
  • Bank transfers
  • Corporate accounts and invoicing
  • Cash payments (where applicable)

Late payments may incur additional charges. Returned payments due to insufficient funds will result in additional administrative fees. For recurring services, automatic billing will be established unless other arrangements are made in writing.

6. Cancellations and Rescheduling

Cancellations and rescheduling must be made with at least 24 hours notice. Cancellations made with less than 24 hours notice may incur a cancellation fee of up to 50% of the scheduled service cost.

For emergency situations or cancellations due to circumstances beyond your control, please contact us immediately to discuss alternative arrangements.

We reserve the right to cancel or reschedule services due to emergency situations, weather conditions, or staff availability. In such cases, we will attempt to provide as much notice as possible and offer rescheduling at no additional cost.

7. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to the collection and use of your information in accordance with our Privacy Policy.

8. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of DustGuard Ltd and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain ownership of content you submit to us, but grant us a license to use such content for providing our Services.

9. Limitation of Liability and Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DUSTGUARD LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our liability for any damages arising out of or related to these Terms or the Services shall not exceed the amount paid by you for the Services in the twelve (12) months preceding the claim.

Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Insurance and Liability

DustGuard Ltd maintains comprehensive general liability insurance and professional indemnity insurance. Our staff are fully trained, bonded, and insured. However, we recommend that customers:

  • Secure or remove valuable items before our services begin
  • Inform us of any fragile or delicate items requiring special care
  • Document any existing damage before our services commence
  • Report any damage or concerns immediately following service completion

Claims for damage must be reported within 48 hours of service completion. Please contact us with any concerns or claims.

11. Force Majeure

DustGuard Ltd shall not be liable for any failure or delay in performance under these Terms which is due to fire, flood, earthquake, elements of nature, acts of God, war, terrorism, riots, civil disorders, rebellions, or other causes beyond our reasonable control.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising from these Terms or the use of our Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.
